OHS IN AUSTRALIA
OHS in Australia applies in any industry where people are employed to work. Employers have a duty of care to provide workplaces that are safe and without risk to health. Employees have a duty while at work to take care of their own safety and the safety of others and co-operate with their employer.
Model work health and safety (WHS) laws
Safe Work Australia is currently developing model work health and safety laws as part of an initiative of the Council of Australian Governments. This initiative demonstrates a commitment to improving the work health and safety of all Australian workers and enhancing productivity.
The Commonwealth and each state and territory government have agreed to harmonise their work health and safety laws (including Regulations and Codes of Practice) so that work health and safety laws are similar in each jurisdiction.
The Model Work Heath and Safety Act (draft) endorsed by Workplace Relations Ministers Council is now available.
Public comment
The public comment period for the draft model Work Health and Safety Regulations and model Codes of Practice closed on Monday 4 April 2011 and the MPMSAA Model WHS Regulations and codes of Practice Public Comment Response submission is now available.
Our submission contains the views of; members expressed to the MPMSAA through day-to-day contact; The Australian Chamber of Commerce and Industry (ACCI) Occupational Health and Safety Working Party Meetings; and discussions with our key stakeholders.
From 1 January 2012 there will be a new, harmonised approach to Workplace, Health & Safety in Australia. Each jurisdiction is still responsible for its own legislation but each will be based on the model WHS Acts and Regulations. This should ensure a consistent approach to WHS across jurisdictions.
The Work Health and Safety legislation and 11 Codes of Practice came into effect on 1 January 2012 in New South Wales, Queensland, the Australian Capital Territory, the Commonwealth and the Northern Territory.
Safe Work Australia Model Codes of Practice are intended to provide practical guidance on how to achieve compliance with the requirements of Work Health and Safety (WHS) legislation. A Code of Practice applies to anyone who has a duty of care in the circumstances described in the Code, eg confined spaces or hazardous manual tasks.
Codes of Practice can be used as evidence of what is known about a hazard, risk or control and are admissible in court proceedings. A court may rely on the Code in determining what is reasonably practicable under the WHS Act and Regulations. The model Codes of Practice on WHS have been developed by Safe Work Australia.
An updated version of the SWA Model WHS Regulations (dated 4th November) is available on the SWA website. Technical amendements have been made and please note that Commonwealth, Qld, NSW ACT and NT have already adapted these regulations for their own jurisdictions.

It is now expected that all laws will commence in Victoria on 1 January 2013. After the enacting of the new legislation. The MPMSAA will commence the update of our WHS Management Plan Template and disseminate it to those who already have a 'registered plan' and are 'financial' for implementation for a small fee.
The development and implementation of an WHS system based on the principles of risk management and consultation is recommended by MPMSAA to it's members to ensure the health and safety of all employees, independent contractors and their employees, the general public and protection of facilities, plant, equipment and the environment.
Another three reasons to establish an WHS system are:
- Government fines and penalties
- Lawsuits and negligence claims
- Increased workers compensation premiums
The MPMSAA OHS Officer is available to assist members with WHS compliance documents and information on safe work practices and can also help members create, manage and maintain an effective WHS System to ensure a safe work environment.
